Cy, Pres, Love: Judicial Discretion and Conflicts of Interest in Cy Pres Settlements
Cy pres awards have exploded in popularity, increasing by 800% since 2001 according to some studies. These settlements are seen most commonly in class actions involving the widescale misconduct of large technology companies as conflicts over data and privacy have increased over this same period. The growing popularity of cy pres has revealed a troubling weakness in this model of ethical adjudication: class counsel, as well as judges and defense counsel, are empowered to provide large sums of money to organizations in which they may have — or appear to have — a significant interest. This Note argues that while these settlements do not violate the Model Rules, these conflicts and potential conflicts of interest nevertheless promote attorney behavior that disserves the class.
